COCHISE COUNTY., Ariz. -- Butler County's Sheriff and a key state legislator are far from home looking for evidence and support for a tougher immigration law in Ohio.Sheriff Richard Jones and State Representative Courtney Combs (R-Butler County) are in Cochise County, Arizona on the border with Mexico.In a telephone interview with 9 News, Sheriff Jones said he could see the evidence at the border having witnessed videos of illegal immigrants crossing it within relatively close proximity to a Border Patrol station.Jones and Combs want Ohio to pass a law similar to Arizona's. That law gives local law enforcement officers the right to ask a suspect for proof of U.S. citizenship and allows them to enforce federal immigration laws.Jones says the illegal immigrants crossing the border in Arizona are not staying there. He says many of them are criminals and they are bringing crime to Ohio.Jones is not optimistic that the Ohio legislature will pass the anti-illegal immigration law he wants. That's why he is also supporting a push to put it before the voters in a statewide referendum.

While most of the nation is focused on methods to "unite" to stop the largest invasion in world history, ALIPAC's William Gheen has repeatedly attacked, undermined, and impuned the efforts of others, with little regard for the facts or the truth, taking credit for anything and everything that grassroots Americans have endeavored to accomplish for the common good. Dan Amato of Diggers Realm has chronicled what actually transpired during this latest outrageous intolerable act by ALIPAC's William Gheen.
P.T. Barnum was credited with saying "There's a sucker born every minute." Apparently, William Gheen of ALIPAC has taken that adage to heart, and adopted it to justify any action he chooses to take. From my experience, if Mr. Gheen cannot either take credit for, control, or profit from actions that other patriotic Americans are engaged in, that he systematically tries to destroy the event, discredit its organizers, and make himself the victim, with little to no regard for the truth, all the while claiming some self-righteous responsibility to "police" the anti-illegal alien invasion cause. He should be policing his own behavior.

Recently, Mr. Gheen lashed out at some of the hardest-working patriots in the cause, including The Rocky Mountain Foundation founder, former Congressman Tom Tancredo, and Voice of the People USA founder, Daniel Smeriglio, calling them neo-Nazi supporters. The truth has set Mr. Tancredo and Mr. Smeriglio FREE!

I most strongly encourage anyone who wants the facts to read the detailed account prepared by Mr. Dan Amato of Diggers Realm below, and make your contributions in the future to groups who aren't poison to the cause.
Whether it is Mr. Gheen, or others inside-and-outside the Beltway, I am disgusted by carpetbaggers and profiteers who "claim" they want to solve these problems all the while filling their pockets, drawing fat salaries, and undermining the efforts of the TRUE sons and daughters of liberty! I am posting this announcement with Jim Thompson’s blessing and support.
Patriotic Americans all across the nation are being called on to ‘flaunt the American flag’ on Wednesday, May 12, 2010 by wearing patriotic-themed clothing such as American flag style shirts, blouses, ties or jackets; American flag lapel pins or brooches; and by displaying the American flag at home, on your car or at your desk at work. You can even carry an American flag with you as you make your rounds on Wednesday and really flaunt that flag!
This is being done as a show of support for the American families in Morgan Hill, California whose students attending Live Oak High School were ordered to remove their American flag style shirts so as to not offend Mexican students on Cinco de Mayo last week.
Offended Mexican students walked out of class the next day and staged a protest march demanding “respect” for “our holiday” by demanding Americans not display the American flag on American soil.
One protester, Luis Jimenez, was videotaped by KNTV-TV saying, “Yesterday, it was our holiday, Cinco de Mayo. All of, like, the Americans thought they could wear their flags and just flaunt them in front of us.”
Another Mexican protester was videotaped by KRON-TV ripping an American flag out of the hands of an American that same day.
In response, please send this message: We Americans will flaunt our flag on our soil anytime we please. If some folks don’t like that, we have an old saying for them, “America, love it or leave it!”
Please e-mail and post this call to action on blogs, Facebook, Twitter and send it to you local and national Tea Party groups and talk radio hosts.
(Note to all the race-baiting liberals and weak-kneed David Brooks types, this is not about race, or even about Mexico. This is about Americans standing up for America on American soil. If you can’t handle displays of patriotism, the same message above applies to you too.)

An area lawmaker and law enforcement official known for their tough stances on illegal immigration have asked Ohio officials for legislation similar to a controversial Arizona law.

Butler County Sheriff Richard Jones and state Rep. Courtney Combs sent letters Tuesday to Gov. Ted Strickland, Senate President Bill Harris and Speaker of the House Armond Budish urging them to develop and pass a law that mirrors Arizona's

Under the new law, legal immigrants would required to carry documents to prove their status and law enforcement officers would be required to check the legal status of anyone they suspect of being undocumented.

Arizona's law has drawn wide criticism, including from President Barack Obama, and is expected to face numerous legal challenges when it goes into effect this summer.

“Our federal government has failed us when it comes to securing the border and stopping the flow of thousands of illegals entering this country on a daily basis," Jones said. "If the federal government won’t do it, it is time that states take that responsibility upon themselves."

Jones and Combs, who have teamed up before to promote changes to immigration laws, hope to travel to Arizona to meet with Gov. Jan Brewer, who signed the bill into law April 23, to discuss the legislation.

Butler County reached a $100,000 settlement last week with an illegal immigrant who was arrested at a construction site and later deported to Mexico.

Attorneys for illegal immigrant Luis Rodriguez, who was accused of providing false documentation, filed a federal lawsuit in 2008, saying Butler County sheriff's employees illegally questioned him.

The lawsuit also said the sheriff's office did not have authority to enforce federal civil immigration law.

Jones said he believes he has authority to enforce immigration law and that the county had a good chance of winning the lawsuit, but the sheriff said a loss could have affected other law enforcement efforts to make similar arrests.

2 Injured After Fight Breaks Out Between Teen Groups

FLORENCE, Ky. -- Two people are recovering from injuries after a large fight among teenagers in Florence Monday night.

The fight broke out between what police say was a group of 10 to 20 Hispanic and white teenagers around 9:30 p.m. at an apartment complex on Wysteria Village Drive.

"What separates this from the other fisticuffs we see is as the weather warms, one of the boys got stabbed in the chest with a knife and another got beat with a ball bat," said Tom Scheben with the Boone County Sheriff's Office.

Police say 18-year-old Sean Switzer, of Erlanger, was stabbed in the chest and 15-year-old Brandon McDaniel, of Florence, was beaten with a ball bat.

McDaniel refused treatment and Switzer was taken to University Hospital with what are described as non-life threatening injuries.

Police say early investigation shows a group of white teens confronted a group of Hispanics. Police say the Hispanic teens call themselves "Brown Pride".

Wysteria Village Drive cuts through their two neighborhoods and residents say the teens often gather there in large groups.

"They cut either from the trailer park or from the subdivision over there and they just come through," said Sharon Bintz, a neighbor.

Residents on Wysteria Village Drive are also concerned by the words "Brown Pride" that have been spray painted on the street. The initials BP can be found throughout the area.

"Are they wannabes? Are they a gang? We haven't seen they are necessarily an organized gang but we have also seen tagging down in the area so they are on our radar and they have been off and on," said Scheben.

Boone County is now stepping up patrols in the area as neighbors worry about what may happen next.

"It's scary. It really is," said Bintz. "We just moved here recently and we thought we were moving to a nicer neighborhood and now we are kind of afraid. We have four children that live with us so it's scary."

No arrests have been made.

Rare drug found in Ohio hotel bust

Police busted a man in possession of 5 kilos of a rare drug at a hotel Tuesday night, NewsChannel5 sister station WCPO-TV in Cincinnati reported.

Police arrested 20-year-old Omer Mohamed at the Red Roof Inn in Blue Ash for allegedly being in possession of a large amount of a drug called Khat. Police said that 5 kilos of Khat were found wrapped in banana leaves, ready for sale.

Khat is a little known flowering plant banned in the U.S. that is native to East Africa that acts like a stimulant because it can cause euphoria. People generally chew the drug to achieve the high.

Blue Ash Police Capt. Jim Schaffer said it is the first time his department has ever seen the drug, and he suspects that is the case for most, if not all, departments in the area.

Schaffer said Mohamed was having the drugs shipped to him at the hotel, and the suspect would pick them up as he checked in as a registered guest. Police were acting on a tip in Mohamed's arrest.

Authorites said they do not expect to make more arrests.

Mohamed remains locked up at the Hamilton County Justice Center as of Wednesday morning.

Mohamed has an address in Galloway, Ohio, but is originally from the country of Somalia and immigration agents have gotten involved in the case.

Three guilty of hiring illegal immigrants

Three Cincinnati construction contractors face up to five years in prison after pleading guilty this week to tax charges related to the hiring of illegal immigrants.

Federal prosecutors say all three men tried to conceal payments to illegal immigrants by writing checks for large amounts of money to a handful of employees, who then gave the cash back to the contractors so they could pay dozens of workers off the books.

Chakib Roumani and Alfonso Padilla, who operate R.M.P. Construction Inc., pleaded guilty Tuesday to tax evasion charges in U.S. District Court in Cincinnati. Reyes Mijangos, who operates R&T Drywall and Reyes Construction, pleaded guilty to failing to collect and pay employment taxes.

Prosecutors say Roumani, 37, and Padilla, 45, employed at least 20 people as construction laborers, and most of them were illegal immigrants.

According to court records, the two men issued checks to two employees for the entire weekly payroll amount and then paid the others with cash from those checks.

If the total payroll was more than $10,000, prosecutors say, Roumani and Padilla would issue multiple checks to avoid federal currency reporting requirements for banks.

IRS investigators say the two men concealed payments of about $1 million between 2005 and 2006, resulting in a tax loss to the IRS of about $150,000.

Mijangos, 48, employed between 50 and 100 people at his companies, prosecutors say, including many illegal immigrants. He paid wages totaling more than $2.2 million in 2005 but avoided paying employment taxes by writing checks to only a few employees, who then paid the others.

U.S. District Judge Herman Weber accepted the pleas Tuesday and will sentence all three men in April.

A man who hit five vehicles, injuring seven people, while driving drunk the wrong way on the south Outerbelt pleaded guilty today to three counts of aggravated vehicular assault.

Baltazar J. Altunar, who was injured so badly that a medic believed he was dead, hobbled into Franklin County Common Pleas Court with the help of a cane to admit he'd been drunk when he drove against traffic for 5 miles on I-270 on Christmas Day 2008.

"I fell asleep, and I went the wrong way," Altunar, 21, told Judge John F. Bender.

Drivers skidded, swerved and - in one case - rolled off the highway to avoid his Nissan Maxima, which was traveling west in the eastbound lanes of I-270. Altunar hit three cars before slamming into a tractor-trailer and colliding head-on with another vehicle about 10 a.m. near Alum Creek Drive, witnesses told police.

Altunar, who lived on Derrer Road, had a blood-alcohol level of 0.219 percent. An Ohio driver is considered intoxicated at 0.08 percent. Empty beer cans and a cardboard beer case were found in wreckage surrounding the Nissan.

A medic who was at the crash scene but not involved with the rescue pronounced Altunar dead, but other medics saw signs of life. Altunar was hospitalized for five months and said in court he is facing at least one more operation, to close a wound in his chest.

Altunar is an undocumented immigrant from Mexico and will be deported after serving any prison sentence. Bender ordered a pre-sentence investigation and said he will sentence him Feb. 12. Altunar had been charged with six counts of aggravated vehicular assault and two counts of driving while intoxicated. Five of those counts were dropped as a result of his guilty pleas to the three felonies, which involved injures to three people in the same vehicle.

In a separate case, Altunar pleaded guilty to drunken driving in 2007, court records show.

TOLEDO, Ohio – Two men are to be arraigned today on drug charges in connection with 44 pounds of cocaine seized by the State Highway Patrol in a traffic stop.

Audel Rios, 31, of Meriden, Conn., and his passenger, Christian Paul Carrillo-Meza, 27, of Mexico, were charged with aggravated possession of cocaine, and aggravated trafficking.

The patrol stopped a 2005 truck towing a flatbed trailer without registration at 1:14 p.m. Friday on the Ohio Turnpike.

"Troopers observed criminal indicators and a patrol drug-sniffing canine alerted to the vehicle," according to a news release. "A probable cause search revealed 20 kilos of cocaine. The suspects were incarcerated in the Lucas County Jail."

Police said each suspect faces up to 20 years in prison and a $40,000 fine, if convicted.

The patrol put the street value of the cocaine at $2 million. Ohio HIDTA (High Intensity Drug Trafficking Area) - the federal group that coordinated law enforcement efforts in the state - said that much cocaine would be worth about $620,000.

By now most of us realize that the government handled the $700 billion bailout of the big banks badly. The money went out in a whoosh to the Wall Street outfits that had created the crisis, but without the needed regulatory changes to prevent its repetition.

Is Congress about to make a parallel mistake about the illegal alien population and give that group a blanket amnesty like the one it lavished on the (much smaller group of) bankers, without giving a thought to the inevitable impacts of such an action?

With that dubious prospect on the horizon, it is a good time to take a careful look at the dysfunctional inner workings of the last major bailout of America’s illegal alien population, the alien legalization program that Congress created with the passage of the Immigration Reform and Control Act of 1986 (IRCA).

It is well known that some 2.7 million aliens secured legal status — many of them fraudulently — in that program, but there has been little discussion of the strange inner machinations that caused so much of the problem.

It so happened that, at that time, both a major foundation (Ford) and a minor federal agency (no longer surviving)¹ asked me to evaluate the on-going operations of IRCA’s amnesty. A colleague and I spent nearly two years examining the program, visiting amnesty facilities across the nation and talking with hundreds of people involved in the program, from the Immigration and Naturalization Service Commissioner to the shakiest of applicants.²

It is now clear that:

The agency running the program, the old Immigration and Naturalization Service (INS), far from being the tough law-enforcement agency the immigrants’ advocates feared, turned out to be a typical governmental agency with a strong case of client-itis, one that usually said “yes” to its applicants.
Operating without many useful precedents, INS created a new and questionable decision-making process that severely hampered the detection of fraud.
A great deal of money intended for the legalization program was diverted to other government programs.
As a result, there was a tremendous amount of fraud, largely ignored by INS. A subsequent Center for Immigration Studies estimate, based on population estimates, found that fully one quarter of those granted legal status had secured that status through fraud.³

The Setting for IRCA Decision-Making

The Political Background. IRCA was an omnibus immigration law, an attempt to form a grand bargain that would take care of many immigration policy disputes. Part of it was the introduction of “employer sanctions,” saying that it would be illegal, in the future, for employers to hire illegal aliens; the other part was the legalization package. The promise was that sanctions would eliminate the lure of jobs in the U.S. economy and the legalization package would put several important groups of illegal aliens on the path to citizenship, thus shrinking the size of both the current and future illegal populations. There were extensive hearings and much public discussion of the various issues.

The grand bargain was supported by President Reagan and his Attorney General, Ed Meese, as well as by the leaders of the GOP-controlled Senate and the leaders of the Democrat-controlled House. The chairman and ranking member of the Senate immigration subcommittee, Sens. Alan Simpson (R-Wyo.) and Ted Kennedy (D-Mass.), had devoted considerable time and energy to its drafting, as had the House subcommittee chairman, Rep. Romano Mazzoli (D-Ky.). House Judiciary Committee Chairman Peter Rodino (D-N.J.) was similarly supportive.

Meanwhile in separate, off-stage negotiations, three key young Democratic members of the House put together a compromise that satisfied representatives of both the (largely Hispanic) farm workers and the California growers. Working around a kitchen table in one of their bachelor apartments on Capital Hill, then-Rep. Leon Panetta (D-Calif.), who spoke for the growers, Rep. Howard Berman (D-Calif.), who spoke for the illegal farm workers, and the broker, then-Rep., now Sen., Charles Schumer (D-N.Y.) created a compromise provision for Special Agricultural Workers, or SAWs. The trio then convinced other members of Congress to accept their provisions for farm workers.⁴

In short, legalization came into being with a considerable head of steam. It was only later that it became apparent that no serious effort would be made to either enforce employer sanctions or to create a national ID card that would make it easy for employers to identify legal, as opposed to illegal, immigrants.

IRCA’s Terms. The new statute (Public Law 99-603) was very complicated and was fully 100 pages long. It provided for four separate alien legalization programs, two of them quite narrow and never subject to much controversy,⁵ and two much broader programs.

Section 245A of the newly-amended Immigration and Naturalization Act gave legal status to applying aliens who: a) applied between May 5, 1987, and May 4, 1988; b) had been in the country more or less continuously since January 1, 1982; c) who did not have serious criminal records; and d) who met some other stipulations. A total of 1,763,434 aliens applied under this provision.⁶

The other major activity, the SAW program, gave legal status to those aliens who had done seasonal farm work in the United States for at least 90 days in 1984, 1985, or 1986 and who applied between June 1, 1987, and November 30, 1988. This provision drew 1,277,041 applicants.⁷

Both the SAW and the pre-1982 programs created a new, and passing, legal status for those approved. They became legal Temporary Resident Aliens (TRAs), a step toward green card status. While they were in this category their access to government-funded programs was limited, and they could not use the status to bring more immigrants into the country; they were, however, in legal status and could cross the border through the ports of entry.

The whole program was tilted strongly toward making legalization much easier for the farm workers, thanks to the deal engineered by the three young House members, and by the strength of the growers’ lobby. Not only did SAWs have to prove much shorter stays in the United States, they had a longer application period and the reward for eligibility was greater than for pre-1982 aliens. The SAWs, for example, unlike the pre-1982s, did not have to meet any English-speaking or civics requirements to secure a green card; they could, under some circumstances, apply from outside the country; and their transition from TRA status to green card status was automatic, as it was not for the pre-1982s.⁸

The paragraphs above touch only lightly on the extreme complexity of the program; there was, for instance, an ongoing controversy about a provision of the bill that required continuous residence for applicants except for “brief and casual” returns to the home country. The phrase was subject to continuing controversy, pressure from the immigration bar for a loose regulation, rounds of rule changes by INS, and more rounds of court decisions, with the result that the allowed periods of absence grew as the program progressed, and thus the number of eligible aliens continued to expand.

Institutional Inclinations. Another (and largely unrecognized) part of the IRCA setting was the inherent tendency of a governmental agency to be nice to its clientele. Schools and hospitals admit far more people than they turn away, for example. As we have noticed in the financial crisis, the SEC has not been unkind to brokers, nor has the Federal Reserve been beastly to the bankers. When I was in college, a political science professor used to single out the then-existing Interstate Commerce Commission for its very gentle regulation of its clients, the railroads. He called it “clientitis.”

It was only natural — but rarely discussed — that the INS would act in pretty much the same way in the legalization program. In retrospect, I must say that it certainly did, though I did not consider that a factor at the time.

Later in my work with immigration policy I remember a conversation with a former U.S. consul general in Manila; he made a strong point to me about how much more work is created for an individual consular official when he or she rejects a visa application, as opposed to approving one. There are reports to write, appeals to cope with, letters from local politicians criticizing the decision, and the like. But with an approval, except for the odd one that goes wrong, there is no further work. Institutionally, it works the same way.

The Mood Inside INS as Amnesty Approached. As I recall, and this is quite subjective, the mood within INS, which I knew pretty well at the time, was interesting.

On one hand the agency (largely a law-enforcement shop) had never run a massive short-term benefit program in the past; its executives wanted to tackle their new duties energetically, and their prime worry was that the eligible population might be frightened away by the long-standing law-enforcement image. On the other, the leadership knew that there would be fraud, but its detection did not appear to be a truly major concern as the program began.

There was a lot of enthusiasm for the program, at least initially, at the staff level. We kept running into people who had been, for instance, detention officers, who now were running local legalization programs and pleased as punch to be, perhaps briefly, wearing white hats.

External Pressures All One Way. Another element in the IRCA setting was the imbalance of forces playing on the program once it got underway. Neither the White House nor the Justice Department nor the Congress paid much attention to the program’s operations, or its evolving regulations. The restrictionists were largely quiet,⁹ but the pro-broad-immigration policy people were extremely active. There was extensive lobbying regarding the necessarily complex regulations at the national level, day-to-day pressure from like-minded organizations at the field office level, and a series of lawsuits, most of which were decided on a pro-immigrant-rights basis by the federal courts.

Given the rest of the IRCA setting, these pressures opened a long series of doors that permitted the legalization of many questionable applicants.¹⁰

IRCA Decision-Making Operation

The Structure. As the leaders of INS designed the organizational structure for the forthcoming legalization program, they not only worried about the levels of participation by the resident illegals, they also bore in mind a pattern of INS decision-making that they did not want to continue.

The pattern was in the naturalization program, a decades-old responsibility of the agency.¹¹ Adjudicators in the district offices had made decisions on the applications, following interviews, without much Central Office (CO) review, and the approval rates (in the first half of 1985) ranged from 44.1 percent in the Harlingen Office (on the U.S.-Mexico border) to 88.4 percent for the much smaller volume in the Anchorage Office.¹² The CO wanted to obtain a much more consistent set of decisions in the new legalization program.

In addition, the CO sought more centralized control of the whole process, and wanted, thus, to diminish the independence of the 34 district directors, all veteran civil servants who had become used to running their own operations. INS had at the time a superstructure of four regional offices but the real power in the field lay with the district directors.

Further, there was a governmental precedent for handling millions of paper-based decisions each year, and that was within the Internal Revenue Service (IRS). Some key players in the CO visited several IRS processing facilities to see how they handled the annual flood of paper from the nation’s taxpayers.

Finally, there was a precedent within INS for “remoting” some decision-making on fairly simple issues, such as the extension of a student visa.¹³ The CO noticed that some of the district office adjudicators had much more work than they could handle while, simultaneously, there were times in the middle of the night at the border crossings when officers there had little to do. So some of the decisions that could be made on the basis of paperwork alone were shipped or “remoted” from the district offices to the ports of entry.

With all these considerations in mind, CO devised a brand-new decision-making structure for the brand-new program. In order to both decrease traffic in the existing district offices, and to create a series of legalization-only offices with no law-enforcement overtones, the CO opened a string of 107 legalization offices. They were, organizationally, within the ambit of the district directors, but physically (and psychologically) they were separate. These offices were staffed with some current INS people, some INS retirees (often acting as supervisors), and many others, often with experience in other benefit-granting programs.

The front-line adjudicators, however, were mostly without immigration experience; they conducted the applicant interviews and then in 99-plus percent of the cases sent the paperwork to four regional processing facilities (RPFs) where the applications were to be further checked and final decisions were to be made. In fewer than 1 percent of the cases “statutory denials” were made at the local level and the applications rejected. These were the worst possible applications; in most, the applicant had filed some papers but did not, in fact, claim that he or she was eligible for the program.¹⁴

Unlike the interviews with naturalization applicants, where decisions were made on the spot, these legalization office interviews were totally non-confrontational. In many cases the interviewer (unknown to the applicant) wrote on the form that the application should be denied and/or that fraud was suspected.

As a matter of fact, we found unpublished INS data showing 882,637 legalization-office-recommended denials on March 24, 1989, as well as more than 300,000 pending cases. By the time the program closed its books, there were only 351,745 non-grants of legal status (we assume that this concept and that of a case denial are the same or approximately the same).¹⁵

Missed Opportunities to Detect Fraud. There were many missed opportunities to detect fraud, particularly in the SAW program where applicants vowed that they had worked in agriculture for at least 90 days.

There was, for instance, a conscientious first-line interviewer who knew something about the rural life and who faced many SAW applicants who did not. She developed a loose-leaf notebook with no text. It consisted of pictures of, and dried leaves from, the kinds of crops that were grown in her area. If someone said that they had picked strawberries, she asked them to show her the strawberry plants in the book; if they could not properly identify them she recommended a denial.

I remember asking the Deputy Assistant Commissioner in charge of the SAW program why the CO had not instructed field offices to replicate what she had done, and he said, in effect, there was no political will for spending time and energy on such things when the courts were constantly ruling against INS.

Similarly, there was a gold mine of computerized information in the files of the California Department of Employment Security on wages paid to farm workers by growers; it related to the state’s temporary disability insurance program. There was no effort made by INS to verify claims by California SAWs that they had worked for a specific employer by checking the state’s tax records for that employer.

Susan Gonzalez Baker, in her highly useful book on the IRCA program,¹⁶ describes a similar situation: an assertive SAW fraud-detection program that was developed by the Houston Legalization Office, but not adopted nationally. The Houston office had conducted intensive interviews with 2,000 SAW applicants and gave recommendations for approvals to no more than 300 of them.

How to Handle Case-by-Case Decisions. Let me digress for a moment. In the years since IRCA I had two other opportunities to examine, in some detail, how government agencies engage in case-by-case decision-making, and how they deliver the decisions to the person or persons involved.

In the mid 1990s I was asked by INS to conduct a study of the asylum decision-making process, for the internal use of that agency. Asylum seekers have much in common with legalization applicants — both are (usually) in this country illegally, and both want legal status. In the case of the asylum seekers they might qualify for refugee status were they in their home country, or nearby, but the seekers had managed to make their way to the United States.

INS, much as it did with IRCA legalization, had set up a string of separate offices to handle such claims, apart from the usual field office system. INS had established a separate career ladder for staff serving as asylum decision-makers. (This was the case then; I do not know how this is done now.)

The asylum seeker was, after some preliminaries, interviewed by an asylum officer. The officer asked a bank of questions and the interview was concluded. The officer later reviewed what was learned in the interview, checked out the conditions in the country of origin, made a recommendation, and passed it on to a supervisor, who usually accepted the recommendation. Once all that was done the seeker was called back into the office and was told the status of the case by someone other than the interviewing officer.

The asylum decision-maker, much like the first-line legalization interviewer, did not have to tell the alien face-to-face what the government’s decision was.

About the same time, I was appointed by the governing body in Arlington County, Va., to be chair of the local board of tax appeals.¹⁷ I served for over 10 years. There were five of us on the board and we handled real estate assessment appeals from home owners and owners of commercial properties. It was a part-time activity involving some 100-150 appeals a year, from owners of modest ($250,000) houses to those who owned or represented corporations with $100 million structures.

We held a hearing on each appeal, discussed what we had heard, and made a decision with the appellant in front of us. Usually we dismissed the appeal; sometimes we voted a reduction, but rarely as much as the appellant wanted. Although it was in the grand Wilsonian tradition — open covenants, openly arrived at — the five of us often faced some pretty hostile reactions, more likely from individual homeowners than from the professionals speaking for corporate interests.

From time to time I reached out to other Virginia boards of tax appeals to see how they handled their programs. (There was then no organized communication among the tax appeal boards.) Many of them had decided, for understandable reasons, to listen to the arguments at public sessions and then retreat into private sessions to make the decisions, which were then transmitted by letter.

All of these systems — those of IRCA legalization, the INS asylum program, and the non-Arlingtonian tax appeals boards — take a non-confrontational approach to delivering decisions to the appellants; it is likely that DHS will take a similar approach if another legalization program is mandated.

That would be a mistake. While the IRCA approach provides a more pleasant atmosphere for the front-line staff, it comes at a considerable public cost — there is be no opportunity to “break” a bad case during the applicant’s first contact with the system. In this way a large number of inappropriate claims can be eliminated from the system at the very start of the process. (Baker’s report about the Houston office task force, noted above, makes a similar point.)¹⁸

What is needed is the revival of part of the process that was not used (or was seriously downplayed) during IRCA, which is the penalty-free withdrawal of an application during the initial interview. Many weak claims to naturalization, similarly, were allowed to be withdrawn during the old naturalization processing — these were far more numerous than the formal denials of a claim, as I discovered in the previously mentioned Ford Foundation-supported study.¹⁹

If there is another legalization program, which I do not advocate, the following scenario should have a chance to play out. If the applicant seems to have a weak or apparently fraudulent application, the interviewer would then tell the applicant that this was the case, and give the applicant two choices: either proceed with the application, and possibly run into trouble if it is rejected, or withdraw it.

If the latter occurs the applicant is told that his or her name and address will not be forwarded to the enforcement people and the fee will be refunded (or perhaps not collected in the first place). The Department of Homeland Security would, however, retain a one-page cover sheet (with a photo and a thumbprint) as a record of the application’s withdrawal. All applications filed would then be matched against the file of those that had been previously withdrawn.

The applicants in the IRCA legalization program never encountered such a situation with the result that, as we will show shortly, a large number of what must have been fraudulent applications were approved.

Another Model — Social Security’s Disability Retirement Decisions. There is another government decision-making system that handles millions of benefit decisions each year on a paper-only basis: the Social Security Administration’s (SSA) disability determinations process. A favorable decision gives the disabled worker a retirement-like pension years before the normal retirement age. Each favorable decision is thus both valuable to the worker and expensive to the government.

In fact, the average value of a favorable decision in 2007 was $209,875, an average benefit of $12,642 a year to beneficiaries whose average age was 48.4 years. There were 818,500 such favorable decisions in 2007.²⁰

The disability determinations are based on applications and medical records sent to a central location in each state and territory; the decisions are not based on interviews. The system is not without its critics, who have long thought it both too slow in responding to applications and not generous enough.²¹ It is a system, however, unlike IRCA, that in most years says “no” to more than 60 percent of its applicants, and says “yes” to less than 40 percent of them.

Perhaps the difference between the high rate of rejections in the disability system, and the remarkably low rate of rejections in the IRCA legalization — 12 percent — relates partially to the perceived costs of the two different decisions.

While both programs have strict legal definitions of eligibility and these are important in both settings, in SSA the management and staff are aware of both the benefits to the individual and the costs to society. I have a feeling that there was no particular sense in INS that a grant of legal status in the IRCA program represented any cost to society.

Funding. In addition to an overall environment that tilted toward grants of legal status, and away from fraud detection, there was the matter of funding.²²

Congress had decided that the costs of the legalization program were to be borne by the applicants; the successful ones, after all, would receive a major, life-long benefit. INS decided before the program started that the basic fee would be $185 per application.

The fees collected in the pre-1982 program and the expenses of that program, roughly $400 million, were in approximate balance with other. But there was no similar balance in the SAW program, where fully three-quarters of the $240 million collected in that program — all from the applicants — was diverted to other government programs.

One nicely documented example of such a transfer was reported by Interpreter Releases, the immigration bar’s scholarly trade paper. An assistant INS commissioner announced that $50 million in what he termed excess SAW fees were going to be used to buy INS a whole new generation of computers.²³ When I reported, during the Ford-supported research, that this money could have been, and should have been, used to identify fraudulent SAW applicants, that assistant commissioner (who will remain nameless) literally screamed at me; I had apparently touched a raw nerve.

In short, one of the reasons why there was so much fraud in the SAW program was because INS siphoned off $180 million or so away from fraud detection.

Immediate Results

Many Legalizations. The principal, immediate result of the IRCA legalization program was the addition of nearly 2.7 million to the population of those legally present in the United States, as Table 1 indicates. About 1.6 million of these came through the pre-1982 program and the balance, 1.1 million, were from the SAW program. There were also a few thousand who had benefitted from the two minor legalization programs, those for long-term illegals and for some of the Cuban-Haitian entrants.

A couple of years after the end of the filing period, INS funded a survey of those who had been legalized through the pre-1982 part of the program. The contractor, Westat, had some troubles reaching the population of interest — and would have had even more trouble had the SAWs been included — but it managed to reach a pretty good sample of 6,193 of them.²⁴ Only beneficiaries over the age of 18 were interviewed.

The study showed that the population was primarily from Mexico (70 percent), a percentage that would be considerably higher if the SAWs were included. The pre-1982 beneficiaries were 58 percent male, had about seven years of education on average, and two-thirds were residents of the border states. California was the residence of 55 percent of them, and Texas 18 percent. Illinois and New York each had 7 percent of the population.

Though the study did not use these words, the population surveyed was mostly at the bottom of the U.S. labor market; 34 percent were laborers, 30 percent were in the service industries, and, oddly, 7 percent were doing farm work at the time of the survey. (Why anyone with farm credentials would have used this program, rather than the SAW program, was not explained.)

The study did note that, “The distribution of workers by occupation and industry was dramatically different for the legalized population than it was for other Americans. The percentage of legalized aliens in white-collar jobs (15 percent) was less than one-third that for the general population....” ²⁵

Much Inaction on Much Fraud. The striking thing about Table 1 to one who has been in close touch with the program is the rejection rate for the two sub-populations, 10 percent of the pre-1982 applicants were rejected, but only 14 percent of the SAW applicants did not get green cards.

Everyone who had any knowledge of the legalization program at the time sensed that there was some fraud in the pre-1982 program, and a great deal of it in the SAW program. We were provided unpublished data from the regional processing facilities in April 1989 that showed the recommended denials (at the legalization office level) were eight times as numerous within the smaller SAW program than they were within the larger pre-1982 program.²⁶

The low rate of SAW rejections is jarring whether one looks at the internal dynamics of the program or at population figures or at the mountains of anecdotal evidence.

As to the program dynamics, bear in mind not only that the time in the United States to be claimed, and hopefully documented, was much less in SAW than in the other program, and that the rewards were marginally better in the SAW program, but there was also a period of nearly seven months between the close of the pre-1982 program and the close of the SAW program. Whatever your eligibility, the only program you could apply to during these months was that for SAWs. These factors, one would suppose, would tend to facilitate more fraud in the SAW program than in the other.

Regarding the analysis of the SAW applicant population vs. other data on the size of the farm worker population, one needs only to look at California, a state that keeps better records on agricultural labor than most. The likely incidence of fraud among California SAW applicants is significant because about 55 percent of the nation’s SAW applicants were from that state.²⁷

As we noted in our Ford report,²⁸ and as many others did as well,²⁹ the number of SAW applicants in California (699,100) was at least twice as high as any other governmental measure of the total farm labor force in that state — even assuming, as one should not, that every bit of farm labor in the state was performed by SAW applicants and that legally resident persons did not pick a single tomato nor cut a single lemon. This statistic would suggest that at least half of the California SAW applications were fraudulent.

Center for Immigration Studies Director of Research Steven Camarota, in a Backgrounder about the proposed Hagel-Martinez Amnesty of 2006, estimated that fully 700,000 of the 1.1 million SAW applicants were fraudulent.³⁰

The anecdotal evidence of the extent of fraud was monumental, as we reported to Ford³¹ and as Baker reported to the Urban Institute.³²

Without belaboring the point, perhaps this piece of our study³³ would be helpful:

We were finishing an interview with a Hispanic woman who managed a small QDE agency that specialized in farm workers, when the following exchange took place:

Question: “In your work with this agency have you ever encountered any applicants who you thought might not be eligible?”

Reply: “Most of the applicants I have seen in the last six months probably are not eligible for the program.”

Question: “What gives you the first clue?”

Reply: “Well, there’s the whiteout on the applications....”

QDEs were “qualified designated entities” (another lovely use of the language), community organizations funded by INS to help applicants apply for the legalization program. Ethnic organizations in the Southwest and local units of the various refugee-serving agencies often secured the (rather modest) QDE funding.

A Muffed Public Health Opportunity. There are public health interventions at some set points in people’s lives, such as the requirement of vaccinations for all entering students by many public schools. Similarly, ever since the days of Ellis Island (which turned away immigrants with what were thought to be dangerous diseases) there have been public health aspects of the immigration process.

During IRCA’s legalization there was a required, once-over-lightly medical interview and blood test for, among other things, AIDS. I had suggested in testimony before the Senate immigration subcommittee that those seeking legalization should also be required to have the same set of vaccinations demanded of school children. This was watered down to a requirement that the medical interview should include questions on vaccinations.

In the years since, the Public Health Service has strengthened its hand and arriving immigrants are now required to have vaccinations.

So while some IRCA legalization applicants learned that they had TB or AIDS — a benefit to them and to the wider public — an opportunity to give vaccinations to three million people — people with minimal health care opportunities — was lost.

Longer-Term Results

The Big Picture. As with the bailout of the bankers, where a small minority secured major benefits at the expense of the rest of us, the benefits from the legalization program are largely private, while the long-term costs are borne by the larger society.

The big picture is distorted by the contrasting visualization of the benefits and the costs. On one hand, the illegal alien who becomes a legal one has made a large, highly visible step forward. That is a black-and-white situation, while the financial costs to, and the demographic impacts on, the rest of us are much harder to appreciate. (Few people who are not near immigration policy understand, for instance, that the newly legalized, particularly after they become citizens, obtain the legal right to bring still more migrants to the United States — our family preference system guarantees that. Fewer still understand the impact on the environment of a fast-growing population.)

We cannot, in this paper, do more than touch on the long-term fiscal and demographic impacts on society as a whole of the changed legal status of these 2.7 million people.

Minor Labor Market Advances. Another factor clouding the cost-benefits analyses of the results of the IRCA legalization program are the writings of statistics-shaping optimists, presumably good people who may not know that their cheerful outlook colors their findings.

For example, one analysis of a second-round of Westat-conducted, INS-funded polling of the pre-1982 beneficiaries 10 years later (in 1992) had this to say:³⁴

A series of analyses based on this sample of unauthorized immigrants revealed a high level of labor force participation with a pattern of moderate upward occupational mobility over time.

Well, yes, but most American adults work and most of us had better jobs at 35 than we did 10 years earlier. And then there was this comment:

By 1992, over 45 percent of men and 27 percent of women had attained occupational status better than the bottom third of all persons in the labor market.

It sounds good until you do the math. For simplicity’s sake let’s assume that there were as many women as men in the sample. Then let’s add 45 percent to 27 percent and divide by half, giving us 36 percent — that’s the group that is above the bottom third. Now let’s subtract 36 percent from 100 percent and we have 64 percent who are, by definition, in the bottom third. So 10 years after they arrived this sample of the legalized population is still about twice as likely to be in the bottom third of the labor market as Americans generally.

We should not be surprised, even though they are here legally, now, because statistics show that, on average, they are a lightly-educated work force with limited to very limited English. And were the SAWs to be included in the survey, the results would have been even more dismal.

While the legal benefits of regularized status can, appropriately, be contrasted as black and white, the labor market differences, 10 years later, appear to be a comparison between very, very dark gray and very dark gray — but some commentators do not have gray on their palettes.

Below-Average Interest in Citizenship. Speaking of gray, that is a good color for depicting the naturalization rates of the newly legalized.

While I have not seen any governmental analysis — it may exist — of the extent to which the IRCA legalization beneficiaries have made use of their new status to secure immigration-expanding visas for their relatives, INS, before it was consumed by the DHS, did provide useful information on another topic, naturalization.

In a study of aliens who arrived in the United States in the years 1979-1982, legally or illegally, INS checked on the differential patterns among three groups for subsequently securing citizenship — the normal flow of legal immigrants, the recipients of the pre-1982 amnesty, and the SAWs. I am assuming that all had an equal legal right to take the citizenship tests, but, as Table 2 shows, the non-IRCAs were more likely to do so than the people going through the legalization program. And within the IRCA program, the pre-1982s were almost twice as likely to go through the process as the SAWs.

One might argue that since Mexican nationals have historically lower naturalization rates than other immigrants, the large numbers of them in the IRCA legalization program must have had an impact on the naturalization rates. But, as the author of that study, Nancy Rytina, shows in one of her tables, even within the category of Mexican immigrants three of the four subsets of the newly-legalized were less likely to naturalize than the non-IRCA immigrants from Mexico. The one exception was what must be a very small population of illegal aliens who had violated their visas, rather than crossing the border by night. Most illegal aliens from Mexico are not visa abusers. Two groups of Mexican national SAWs rounded out her analysis; both had naturalization rates of about half that of the others, 17 percent and 18 percent.³⁵

Recommendations

The United States should not have another legalization program. We have proved that amnesties simply beget more illegals, and they, in turn, beget new and more vigorous pleas for another amnesty. We know, or should know, that more people with limited skills and limited rights in the labor market can only lead to still greater discrepancies between the rich and the poor. Further, as a nation, we seem to be incapable of creating an adequate infrastructure for those who are already living here — why strain it further?
If there is to be a legalization program, there should be no special program for farm workers. If there were to be one, it would certainly be designed to maximize the numbers of approved applications and to minimize fraud control.
If there is to be a general amnesty, it should be narrow in scope, and it should come with a decision-making system focused on permitting legalization only for those who meet the qualifications. It should put heavy emphasis on the initial interview, and make sure that the burden of proof is on the applicant throughout the process, as it was not during part of the SAW program. Similarly, there should be a readily available opportunity for shaky applicants to withdraw and to get their money back if fees again fund the program.
The funding of such a program should be arranged to fully support fraud detection, not only using all the fees collected for that program, but tax funds as well, if need be. There never should be a financial incentive to the managing agency to tolerate fraud, as there was in the SAW program.
Within the U.S. bankruptcy court system, a Justice Department entity, there is an institutional arrangement that might be copied if Congress makes the mistake of creating another legalization program. It is based on the premise that the narrow resolution of competing private interests (creditor vs. debtor) does not always serve the public interest. Separate from the bankruptcy courts there is the Office of the U.S. Trustee, another Justice Department entity. It plays a continuing role as friend of the court, observes what is happening, and when the public interest appears to be neglected, it intervenes with recommendations to individual judges in individual cases.
It would be helpful if a disinterested, well-funded, public body could play the same role should there be a legalization program, intervening on behalf of public policy considerations when the decision-making system focuses almost solely, as it did during IRCA, on the claimed individual rights of applicants.
Further, the statute setting up any legalization program should make it clear that public-interest bodies, just as individual aliens, have a legal standing to argue their point of view. I think IRCA was silent on this point.

Homeland Security Secretary Janet Napolitano has been spending lots of time lately as an unquestioningly loyal cheerleader who enthusiastically supports the administration's comprehensive immigration reform programs.

Meanwhile, other activities that threaten U.S. security were unfolding around her.

Maj. Nidal Malik Hasan (the accused Army officer in the shootings at Fort Hood, Texas) was regularly communicating with a radical Muslim cleric in Yemen.

Umar Farouk Abdulmutallab was receiving al Qaeda crash-course instructions on how to hide a bomb in his underwear and destroy a fully loaded American jetliner.

Homegrown American terrorists were leaving the United States for Pakistan and Somalia to receive instructions on how to kill Americans.

Other homegrown American terrorists were plotting to blow up New York subways.

Ms. Napolitano recently stated her immigration-enforcement activities were so successful that now was the time to implement comprehensive immigration reform, with amnesty for over 12 million illegal immigrants.

However, Ms. Napolitano failed to mention to the American public that between 250,000 and 400,000 illegal immigrants still make successful border crossings annually.

How can Americans call themselves safe when they don't know who is and continues to illegally enter their country?

If hundreds of thousands of penniless illegal immigrants can effortlessly walk across our borders annually, why can't well-trained and well-financed terrorists do the same?

It requires only a few terrorists to slip through to wreak havoc on our country.

Nine years after the attacks of Sept. 11, 2001, both the Obama administration and Congress continue to snooze to the sounds of this ticking time bomb.

I once heard such mindless amnesia described as the "Terrorist Assistance and Facilitation Act."

The signs are popping up at Latino markets throughout Columbus.

"Necesitas ride?" one asks in a mix of English and Spanish. "I'll take you wherever you want."

For a fee, the impromptu taxi services offer transportation to undocumented immigrants who were forced to park their cars because they could not prove legal U.S. residency.

Some are transferring "ownership" of their cars to family members or friends who are legal U.S. residents so that they can remain on the road in legally registered vehicles.

Those without friends or family members here are turning to strangers, paying them $300 to $500 to title vehicles in their names so immigrants' cars carry valid license plates.

Some businesses that employ undocumented immigrants are shuttling their employees between homes and workplaces in vans.

Other immigrants simply have given up, packing up and moving to states where it's easier to register vehicles.

The fallout from the Ohio Bureau of Motor Vehicles' cancellation of 42,503 vehicle registrations on Dec. 9 has been life-changing for illegal immigrants, many of whom are Latino.

BMV figures suggest that more registrations were revoked in Franklin County than any other county in the state. (Nearly 21,000 vehicles registered in the county were threatened with cancellation. The actual number canceled is unavailable.)

It's no longer easy for some families to get to work, school, the doctor or the grocery. The canceled license plates on their cars now serve as a beacon to police and as a potential one-way ticket out of the United States.

As part of a crackdown on improper vehicle registrations by immigrants, the BMV scoured its computers and came up with 47,457 questionable registrations.

It then told those vehicle owners to show up at a BMV office with an Ohio driver's license or ID card or proof of a Social Security number to verify their identities and update their registrations. Nearly 5,000 people did so.

The remainder, largely undocumented immigrants who are in the U.S. illegally, now drive at their own risk. If stopped for driving an unregistered vehicle, they face arrest and potential deportation.

A bid by a Latino organization to obtain a court order to prevent the BMV from canceling registrations failed on Dec. 7, sparking a fear-induced scramble.

"They think this is the end of the world," said Dennis Muchnicki, a Dub- lin immigration attorney who is continuing to press the lawsuit challenging the BMV's action. "People are fleeing like crazy."

Muchnicki might amend his action in Franklin County Common Pleas Court to seek class-action status and demand that the BMV return millions of dollars in fees to Latinos whose registrations initially were accepted.

Joseph Mas, a Columbus lawyer and leader in the Latino community, estimates that up to 10 percent of the city's immigrants have departed. "They don't feel welcome and feel as a community under siege," he said.

Mas described the BMV's move as the first by a state agency to result in the "institutionalism of racism."

State officials reject the notion of discrimination or an illegal foray into immigration status, saying Latinos were not asked to do anything that is not required of all Ohioans seeking to register vehicles.

On Spanish-language radio and at a legal clinic last week, Mas and other lawyers counseled immigrants to transfer vehicle titles to legal friends and family members who then can obtain valid license plates.

But there are risks in the strategy, both for those doing a friendly favor and those demanding hundreds of dollars from Latinos who have nowhere else to turn.

The new "owners" of such vehicles are financially responsible for damage or injuries caused in any crashes. And they could be sent to jail for up to six months if they knowingly allow an unlicensed driver to drive "their" cars.

An undocumented immigrant from Nuevo Leon, Mexico, is among those who have paid to stay on the road. "We put our plates in the name of another lady we know," she said. "We paid her $500." The woman, who requested anonymity because of fear of deportation, also pays insurance premiums on the car to protect the new "owner."

"People are paying whatever for their cars because they're indispensable," she said in Spanish. "But we're still exposed, because if they stop you and ask for a driver's license, they can deport you."

State officials do not know how many immigrants have been caught driving cars with recently canceled license plates.

State law requires sheriff's offices and local police agencies to seize revoked license plates, but it does not allow the State Highway Patrol to repossess plates.

Thousands of cars were registered by "runners," legal U.S. residents who demanded fees of $100 or more to use falsified power-of-attorney forms to register vehicles on behalf of immigrants.

A young father and undocumented immigrant from Durango, Mexico, blames the runners for prompting the BMV crackdown.

The man, who declined to give his name for fear of deportation, said that runners made their living processing plates for immigrants, regardless of their clients' ability to identify themselves.

"You'd pay $200 or $300 for plates and they didn't take any ID, and people are driving around with plates in God-knows-whose names," he said in Spanish.

As the Obamacare debate begins in full stride, it’s important to look ahead. Whether any bill at all passes both houses and is signed by the president is in serious doubt. No matter what the outcome, it is important to look ahead to the great debate in this country pertaining to ILLEGAL immigration.

Perhaps it is also important to realize that those opposed to ILLEGAL aliens running rampant in this country are not people without humanity. This is a country built on such a premise. The unfortunate part is a free society stumbles sometimes over its generosity and must regroup to survive.

Handling this ever-growing problem humanely has put a huge dent in America’s economy. To house, feed and educate millions and millions of ILLEGAL aliens who demand the same accordance’s of those here legally must be solved and soon.

If one is to put compassion on the shelf for just a moment, the following statistics tell the story better than mere words. All numbers have been checked and rechecked with available sources to verify their integrity.

Hopefully the following reasons to end this madness can be understood by the specifics below:

The total cost in dollars for these 12 points and two others (sex crimes & ILLEGAL inmates) is $338.3 dollars.

These figures are purposely from around four years ago. They reflect a closer estimation than today’s figures would simply because there was a rise from 2005-09 and are now down due to the recession or rather back into 2004-05 numbers.

If these figures don’t sway even the most “compassionate” opponent of ILLEGAL alien activity, consider this:

If this problem is not brought under control in the near future, the United States will cease to exist as it has over the last 233 years. It will become a land of many and a shared common bond of absolutely nothing.

In essence, without the rule of law and the sense of “right” living as an American, it will become the “United States of Nothing” that matters.

There has never been more of a certainty. We must enforce our nation’s ILLEGAL alien laws and fund them back to strength with real force behind it. To be an American is every living soul’s right. But it is a right taken on in an organized and legal manner.

To be an American, you must earn the privilege through the laws of our country. There is no other way unless you consider anarchy and chaos a better idea.

Patrol: Ohio ID crime arrests up 8 pct. this year

COLUMBUS, Ohio (AP) — The State Highway Patrol says during the first half of this year Ohio troopers made 8 percent more arrests for identity crimes, compared to the same period in 2008.

Patrol superintendent Col. Richard Collins says effective traffic enforcement is helping to stop "bad guys" from posing as law-abiding citizens. Collins said in a statement Monday that troopers are trained to look out for identity fraud and related crimes.

The patrol says Franklin County, which includes Columbus, had 29 identity crime arrests during the first half, the most among the state's 88 counties. Butler County in southwest Ohio and Lorain County west of Cleveland were tied for second with 18 arrests each.

On July 23, Border Patrol agent Rosas was murdered east of Tecate, California.
The Secure Fence Act of 2006 called for the construction of 2 layers of reinforced fencing along 700 miles of the border, including the following: "(i) extending from 10 miles west of the Tecate, California, port of entry to 10 miles east of the Tecate, California, port of entry;"
Instead of twenty miles of double layered fencing near Tecate, DHS built about three miles of single layered fencing, leaving intact 17 miles of old useless 10-ft. mat fencing full of holes.
Agent Rosas was murdered at a spot less than ten miles east of Tecate.
"The fact that agent Rosas' life might have been saved had DHS had done the job that Congress ordered is an inconvenient truth for the media," said Glenn Spencer of the American Patrol Report.
An amendment to the FY2010 Department of Homeland Security Appropriations Bill would complete the 700-mile double fence.

I thank you for your opposition to Sotomeyer! Please continue to rise up against this Obama steamroller of socialism. This is your time, Senator, the time to stand up and equip yourself like a man, a statesman. Do not cow tow to the Marxist Democrats who are pushing socialism with Obama and Pelosi and Reed. If ever we needed your voice, if ever we Kentuckians, we Americans, needed your voice to cry out against this attack against our Republic it is now. This attempt by Obama and his minions who represent the Marxist socialists to take over health care in America must be opposed with every fiber of your being. I urge you to use all your power and your bully pulpit to rise up. The Lord God will be with you if you stand up with Him. He is raising a standard against this tide of evil. I'm hoping you will take the challenge to redeem yourself and stand for our Constitutional government. If American's wanted socialism in health care it would need to be approved by 3/4ths of the states along with 2/3rds of Congress. Last week, the Senate voted 63-28 to attach the Matthew Shepard Hate Crimes Prevention Act (S. 909) to the National Defense Authorization Act (S. 1390).
The Defense Act addresses funding for the U.S. military, but it now includes an amendment that would give special protections to individuals based on their "perceived or actual" sexual orientation and gender identity.

Wendy Wright, President of Concerned Women for America (CWA), states, "The point of the 'hate crimes' amendment is to create a special class of victims that would get preferential treatment. 'Hate crimes' laws contradict the 14th Amendment to the Constitution and create unequal justice by elevating some groups of victims at the expense of others. Victims who engage in homosexual, transgender, or other sexual behavior get special treatment over victims who are military officers, police officers or veterans. How offensive to add special preferences for homosexuals and transgender people to a Department of Defense funding bill but deny that to members of the military - especially in the wake of a deadly shooting at a military recruiting station and an overall increase in violence against our military.

"Republican senators fought for amendments to protect Constitutional rights, and more amendments are expected this week. The fight is not over yet, and CWA will continue to encourage our grassroots members to convince their legislators to vote for equal justice for all, not special preferences for some."

The United States is in the midst of the largest invasion in world history. In addition to losing eight times as many Americans on U.S. soil at the hands of illegal alien insurgents since 9/11/2001 than we are losing in Afghanistan and Iraq, millions of Americans are forced to compete with 3rd World labor that is illegally in the United States.

According to the Ohio Department of Job and Family Services, unemployment in Ohio reached 10.4% in May 2009, a 25 year high.

Regrettably, de facto sanctuary policies in Ohio are hurting Buckeyes and legal immigrants in the job market, encouraging the abuse of illegal alien workers, and reducing earnings to levels below the “living wage” necessary to survive, let alone thrive in a 1st World economy. As the illegal alien workforce declines, wages will rise. It is a simple matter of supply and demand.

H.B. 184 will help protect jobs for Buckeyes, and for immigrants legally authorized to work in Ohio. E-Verify is one of the most effective and accurate programs the federal government has ever introduced. As of January, 2009, over 100,000 employers were enrolled in E-Verify, and 15 states had mandated some form of employment-eligibility verification according to the U.S. Citizenship and Immigration Service (USCIS).

Remove the incentives that draw illegal aliens looking for work to Ohio, and the non-criminal element will either self-deport or never come here in the first place.

Opponents of the Ohio Job Preservation Act will suggest a variety of reasons for Ohio Legislators to not put Buckeyes first, none of which are moral, or lawful, and in some instances will border on sedition. Article IV, Section 4 of the U.S. Constitution guarantees every state “protection against invasion.”

Aiding and abetting illegal aliens is a felony. Title 8, U.S. Code

Specifically, attempting to aid and abet illegal aliens by conspiring to implement legislation, sanctuary policies, or regulatory changes violates the intent, if not also the letter of the U.S. Constitution’s Article IV, Section 4, the 14th Amendment, Sections 3 and 4, as well as parts of U.S. Code, Title 8, as authorized by the U.S. Constitution’s 14th Amendment, Section 5. It has been in effect 140 years!

H.B. 184 will clamp down on the real culprits responsible for so many Ohio jobs going to illegal alien foreign nationals, will increase tax revenue, and will send a clear message to illegal aliens and corrupt employers: Hiring illegal aliens will not be tolerated in Ohio.

Legislators who fail to take this opportunity to stand behind the legal citizenry of Ohio may be guilty of “misprision of treason,” a felony punishable by fines and imprisonment for up to seven years.

Ohio legislators have the authority and the sworn duty to put the citizens of the Buckeye State first and foremost in all their decisions. Succumbing to special interest groups, big business, and foreign governments in support of illegal alien foreign nationals violates the 14th Amendment, Section 3, and if jobs obtained by illegal aliens are government-contracted jobs, also violates the 14th Amendment, Section 4, which clearly states we cannot pay the bills of those giving support and comfort to insurrection against the Constitution, and sovereignty of the United States. In either case, lawmakers found guilty of such are ineligible to EVER hold public office again.

Passage of H.B. 184 would send two strong messages:

1. Ohio Legislators care about taxpaying, law-abiding citizens, and are taking non-partisan steps to preserve job opportunities for Buckeyes.

1. The gig is up for employers of illegal aliens.

The honest businessman who is competing with employers of illegal aliens will thank you. Unemployed lawful workers in Ohio will see increased job opportunities, and will thank you. Tax revenues will rise, and the plethora of expenses incurred by Ohio taxpayers in support of illegal alien workers will decline.

Attrition through enforcement works! A “yes” vote for the Ohio Jobs Preservation Act should be a no-brainer, and is just plain common sense.

PIERCE TWP. – The man killed Tuesday in a tree-trimming accident was from Mexico, but investigators have been hampered in identifying him because he had more than one ID on him, officials said this morning.

Someone thought to be the brother of the victim could make a positive ID later today, according to the Clermont County coroner’s office.

The name reported to the coroner’s office was Jose Manuel Gonzalez Pano. He was said to be 22.

The man’s body was taken to the Hamilton County coroner’s office for an autopsy, the results of which are pending.

“He did suffer a head injury,” but the cause of death hasn’t been determined, said Deb Hawkins, an investigator for the Clermont County coroner’s office.

A falling branch apparently hit his head, police have said.

The victim worked for the Lewis Tree Service of New York, Hawkins said.

He and three other people were trimming trees along Merwin-Ten Mile Road, just south of Locust Corner Road, when the accident happened.

Merwin-Ten Mile is a county road, but it’s unclear who hired the crew.

None of the other men in the crew could explain to Pierce Township police what happened, so a deputy from the county sheriff’s office who speaks Spanish was sent to help interview them.

The Occupational Safety and Health Administration is investigating the accident, said Dennis Slessman, assistant area director.

June 24 several of us made the trek to Columbus to testify in front of the House Judiciary Committee in favor of HB 184 which in part will require Ohio employers to use E-Verify to validate whether their employees are legal residents or not. You can read more about this important bill below.

We just wanted to give you a heads up on what we will be asking YOU to do to help pass this important legislation.

When the House reconvenes in September, after their generous 2 month summer recess, the OPPOSITION will be given a chance to testify before the Judiciary Committee. At that time, since the recess is so long, we will be calling on you to call and e mail the members of this committee to refresh their minds of our testimony in favor of HB 184.

"Employment Verification, Detention and Sanctuary Bill"
Synopsis
The bill would require public and private employers to register and participate in a status verification system to verify the work eligibility of all new employees and to affirm their participation in the status verification system on their20state income tax returns. Failure to affirm their participation in the status verification system on their state income tax returns constitutes falsification or dereliction of duty. The bill would also require jail officials to make a reasonable effort to verify the citizenship of confined persons who have committed a criminal offenseand to notify the Department of Homeland Security in certain circumstances. It also would require judges and magistrates to consider immigration status in determining a defendant’s bail. Finally, the bill prohibits political subdivisions from enacting an ordinance or policy that limits law enforcement officer or other employee from communicating or cooperating with federal officials with regard to the immigration status of any individual within the state - so called "sanctuary policies."
Background
The government's employment verification system, E-Verify, is operated by U.S. Citizenship and Immigration Services. It was created in 1996 as a pilot program in five states, but has now explanded nationwide to over 120,000 employers who have voluntarily signed up for the program. The goal of using E-verify is to screen out undocumented immigrants by matching employee names and birth dates to their Social Security numbers. .Representative Courtney Eric Combs, the sponsor of the legislation, has worked with Butler County Sheriff Richard Jones to bring forth a bill of this nature, which focuses on employers.

HB 184 was introduced on May 19, 2009 by Representative Courtney Eric Combs (R-Hamilton) and is currently in the HOUSE JUDICIARY committee, and has received two hearing (sponsor testimony and proponent testimony hearings). The bill is co-sponsored by Representatives Batchelder, Jordan, Wachtmann, Uecker, Bubp, Maag, Adams, J., Derickson, Hall, Martin.

Butler County Sheriff Richard Jones and Hamilton State Representative Courtney Combs announced new legislation Thursday to combat what they say are high rates of illegal immigration in Ohio.

The pair held a news conference to support Combs' new bill, the "Ohio Job Integrity Preservation Act" that he is introducing to the Ohio legislature.

It calls on all public and private employers to check their employees' information against a free social security Internet database called "E-Verify" to make sure their applicants are legal residents.

The bill would also open up more entry level jobs for legal U.S. residents.

"With Ohio's unemployment rate increasing, this legislation would provide much needed job opportunities for Ohioans," said Combs.

Sheriff Jones says its now a myth that Americans won't take the jobs that many illegal immigrants are working. He says many white collar professionals are now accepting blue collar labor jobs, simply to have an income. Jones adds, "Ohio's economy and citizens are suffering due to a lack of jobs. It's a sad state of affairs."

The sheriff says the new system would provide new heavy fines against employers who deliberately hired illegal immigrants.

Jones says the hope is that by getting employers to stop hiring illegal immigrants, that will take away any incentive for immigrants to come to Ohio to make money for their families. He adds that he hopes another byproduct of the effort will be to reduce crime rates among illegal immigrants.

If enacted, Combs says it could go into effect as early as this July.

Cops: Driver Flees After Deadly Car Crash

Young Dustin Inman was a typical 16-year-old, who enjoyed fishing and hunting with his father.
On June 16, 2000, Billy Inman and his wife, son, and dog, were in their Pontiac Grand Am, stopped behind a Ford Bronco at a traffic light, when their car was suddenly struck from behind. The impact from the rear-end collision smashed Inman's Pontiac into the rear of the Bronco. The result was an accordian-like crash scene -- the vehicle was destroyed. Billy's son, Dustin was sitting in the backseat with his dog. Both died at the scene. His wife was permanently disabled.
Police say Gonzalo Harrell-Gonzalez took responsibility for the accident, saying he fell asleep in his car and struck Inman's vehicle from behind.
Harrell-Gonzalez was transported to the North Georgia Medical Center, but checked out and is now running from the law. Police thought he may have fled to his father's residence in Birmingham, Alabama -- and now there could be reason to believe they're right.
False Alarm, Oh Brother!
In September 2005, police went to Harell-Gonzalez's father's house in Birmingham, Ala. looking for him with arrest warrants. When they arrived, they found a man believed to be the fugitive. The man however, claimed to be Harell-Gonzalez's brother. Preliminary x-ray records confirmed the man to be the fugitive and he was taken into custody.
However, just days before his October 2006 trial was set to begin, a more thorough examination of dental records proved that the man in custody in fact was Harell-Gonzalez's brother and not him. Family and police were devastated to learn that Harell-Gonzalez's capture was a false alarm due to mistaken identity.

When Jim Donovan went to Arlington to visit the United States Marine Corps War Memorial in Arlington National Cemetery in July 2007, what he found disappointed him and spurred him to action.

“When I found the flag was damaged up there, I was upset,” Donovan said. “I don’t like to see the national flag tattered, dirty, faded. Don’t like to see it, mostly while we’re at war, and we’re at war – two battlefronts.”

Donovan, 61, of Waynesboro, a retired Marine and member of the Ceremonial Guard Company at Marine Barracks 8th & Eye, vowed to make sure the memorial always had a fresh, crisp American flag flying instead.

In November 2007, Donovan helped form a group, The United States Marine Corps War Memorial Flag Detail Inc., also known as Iwo Flags, to ensure that the memorial would always have a proper banner. Through a sponsorship program, the group provides a new flag on a monthly basis.

The memorial is one of the few places where, by presidential proclamation, the U.S. flag flies 24 hours a day, 365 days a year.

In January, Donovan said the group had applied with the National Park Service to place a wreath on the memorial to commemorate the 64th anniversary of the flag raising over Mount Suribachi on Iwo Jima during World War II. At that time, the park service asked if the group would partner with them in an annual ceremony to honor the anniversary.

On Monday, 60 to 70 Marines, seven Iwo Jima veterans, a Medal of Honor recipient and Norm Hatch – the retired photo officer of the 5th Marine Division of Iwo Jima – will take part in the ceremony. Iwo Flags will lay a wreath at the memorial, and the Marines of Headquarters Battalion Henderson Hall will raise the flag between 10:17 and 10:20 a.m., the time at which the first American flag rose over Mount Suribachi on Feb. 23, 1945.

“It’s an honor to be doing this, number one,” Donovan said. “We have a lot of respect for the Marines that are in battle right now. It’s an honor to remember that the Marines that have gone in battle before are remembered through this memorial. And just to be part of the program and make sure that these memorial flags that fly over there are clean and crisp, it’s really rewarding, you stop and think about it.”

This topic has been covered before in the CTB. There was just a ruling in US District Court for the Eastern District of Virginia in Alexandria that should remind us of the difficulties dealing with such matters, even when the law is on the side of the good guys/gals. US District Court Judge Leonie Brinkema, who presides over the criminal contempt case of Sami Al-Arian, ruled in favor of the Government by allowing the prosecution to go forward. Judge Brinkema set the trial date for March 9.
Al-Arian, convicted in Tampa, Florida of providing support to the Palestinian Islamic Jihad (PIJ), has been fighting Justice Department efforts in Virginia to have him testify before a Federal Grand Jury investigating various Islamic charities and think tanks in the northern Virginia area. Al-Arian’s refusal to testify in those proceedings has resulted in him being held in civil contempt by the Courts and has led to the current criminal contempt charges. Several months ago, Judge Brinkema freed Al-Arian on supervised pre-trial release while the Court considered various defense and Government motions. Al-Arian has been residing in the Washington, DC area with some of his family during this time.
It should be noted that Al-Arian, as a result of his Tampa conviction, is also under an order of removal (deportation) from the United States. Al-Arian’s removal would be effected by Immigration and Customs Enforcement (ICE) which is an agency of the Department of Homeland Security (DHS). For a time, Al-Arian had been detained in ICE custody during the pending criminal contempt case proceedings. ICE released him concurrently with Judge Brinkema’s custody order.
A further reminder...Al-Arian, as an alien (foreign national) who has been convicted of a terrorism-related felony, is not only subject to the removal order against him but, quite arguably, is subject to pre-removal detention by ICE whenever the pending criminal case is concluded and, if he is convicted of that violation, serves any time in criminal custody he might receive at sentencing. A Supreme Court decision a few years ago ruled that aliens under final removal orders could generally be held in custody for no more than six months pending the Government’s efforts to physically remove them. If not removed within six months, such aliens must be released from custody.
There are, however, certain exceptions allowed by that Supreme Court decision. Those exceptions include aliens who are involved with or linked to terrorism and are determined to be threats to national security. Arguably, an alien who is feloniously convicted of supporting a terrorist organization would be an alien subject to the longer, and that can even be an indefinite “longer,” pre-removal detention. The question then presents itself relative to the Al-Arian case - what will DHS/ICE do with him when the pending criminal contempt case is concluded and he reverts back to ICE “custody?” Ideally, ICE would quickly remove (deport) Al-Arian pursuant to that removal order. This may be particularly problematic. As has been noted in the CTB before, physically deporting certain aliens, particularly stateless Palestinian aliens who are convicted/known terrorists or terrorism supporters, is often difficult. The issue really is to where does the US Government deport such people and how is that accomplished in a safe and secure manner?
While this task is difficult, it is not impossible. Other such aliens, like Fawaz Damra and Al-Arian’s brother-in-law Mazen Al-Najjar, have been successfully removed. Damra was an Ohio imam convicted of lying on his immigration and naturalization documents about his prior support of the PIJ and other radical Islamists. Al-Najjar, while not criminally convicted, was identified by other evidence as a notable PIJ operative working with Al-Arian in PIJ support efforts in the Tampa area. After significant effort and time, both Damra and Al-Najjar were deported. Damra was detained by ICE pending those removal proceedings. Al-Najjar, in what was a widely contested and media-covered process, was detained for a time, released, and then detained again during his removal case. The Al-Najjar detention case focused heavily on the Government’s partial utilization of classified evidence in seeking to keep him detained. Al-Najjar’s supporters, including Al-Arian, publicly made much of Al-Najjar supposedly being “held without charges” on “secret evidence.” That posture was a radical distortion of reality.
We will have to wait and see what DHS/ICE ultimately does in the Al-Arian case. If, at the appropriate time, ICE declines to take Al-Arian back into custody pending removal, it would be entirely appropriate to ask why they did not take such action.

The Federal Immigration Reform and Enforcement Coalition (FIRE Coalition) is pleased to announce the formation of a new area chapter in the Greater Cincinnati area, being organized by Greg Edwards.

Due to the absence of any realistic efforts by the Federal Government to enforce the U.S. immigration laws, Tri-State and local communities have been forced to address the illegal immigration crisis. Communities across the country have been left to deal with, among other things, overcrowded schools and the burden of educating non-English speaking students; emergency room closures caused in large part by ERs being used by illegal aliens for non-emergency treatment at tax-payer expense; increased demand for a wide range of tax-payer supported social and welfare services; overcrowded roadways and traffic congestion; overpopulation and the resulting environmental degradation; deepening social stratification and division caused by the non-assimilation of large numbers of non-English speaking persons; and loss of jobs by Americans and legal immigrants and a lowering of wages in areas saturated with illegal labor.

We seek to have an impact nationally by acting locally. Contrary to the hollow statements by many politicians seeking to avoid making tough but necessary decisions, we believe that there is much work that can be done on the local and state level to reclaim America. This FIRE Coalition team will be involved in organizing campaigns to fight illegal immigration in the Greater Cincinnati area, such as pressuring local governments to close down sites where unscrupulous employers find and hire illegal labor, to enact laws prohibiting businesses from hiring illegal workers and landlords from providing housing to those that broke our immigration laws, and to raise public awareness as to how destructive illegal immigration is to our communities.

Clermont library settles bible lawsuit

BATAVIA – The Clermont County Public Library has settled a lawsuit with a couple barred from holding a free financial planning seminar because they intended to quote the Bible.

George and Cathy Vandergriff of Pierce Township were paid $2. The Institute for Principled Policy, which joined them in the suit, received $1.
“We were never in it for the money,” George Vandergriff said Wednesday. “We are Christians, we believe in the Bible – that it’s God’s inerrant word – and we believe that everyone could profit from studying it.”
The library will pay $10,000 to David R. Langdon and other attorneys for the Vandergriffs, who filed the suit in U.S. District Court in Cincinnati in June.
Insurance will cover half of the amount paid to the attorneys, or $5,000, said Joe Braun, president of the library board.“We’re disappointed in the fact there was no admission of guilt even though we know the reason they settled is they thought they were guilty,” Vandergriff said.Braun disputed that.“Every member of the Clermont County Library Board is a practicing Christian,” Braun said. “So it’s beyond my comprehension that anyone would suggest we would treat someone in an improper manner because of their religion.”Prompted by the suit, the library board voted in June to limit the use of meeting rooms to library programs. The 10-branch system’s old policy had allowed groups such as the Boy Scouts, the Girl Scouts and other nonprofits to use meeting rooms, but it had prohibited the use of rooms for political, religious or social events.“We regret that we caused this to happen, but at the same time we felt there was a wrong that needed to be righted,” Vandergriff said. “It’s kind of a chicken way to do things. … If they believed their policy was OK, then fight it – but they didn’t.”After the suit was filed, Braun said the library was leery of allowing groups “of any belief and to any extreme” to meet at branches.“I don’t think we should be expending public dollars to fight a lawsuit like this,” Braun said. “Its something that could have been resolved without intervention of the courts had they simply approached the board with their concerns.”The Vandergriffs had requested permission to hold seminars on two days in April at the Amelia branch at 58 Maple St. The request was denied by Dave Mezack, director of the library system.“One of the things we could have done is arranged for them to have met somewhere else – a school, a church or a community building,” Braun said.“We had been holding them in churches before this,” Vandergriff said of the financial seminars. “We started our teaching in church back in the late 1980s.”Vandergriff, 65, said he and his wife, Cathy, 53, are independent Baptists who belong to Lindale Baptist Church in Ohio Township.After The Enquirer first reported on the suit, the couple received an invitation to hold one of their seminars from noon to 4 p.m. Jan. 24 at the Carnegie Public Library in Washington Courthouse, Vandergriff said. The free seminar is limited to 25 people, who are encouraged to bring Bibles. Call the library at 740-335-2540 to register.“We’re really excited about it,” Vandergriff said. “We just started doing them in public venues.”Discussion of the Bible in a library should be protected under the First Amendment right to free speech, Vandergriff said.“I feel that some of the municipalities or other government entities need to understand what the Constitution says – specifically the Bill of Rights,” Vandergriff said.

Border security will loom large for Obama administration

Two years ago, some Republican lawmakers floated a proposal to require all undocumented workers wishing to become Americans to first return to their countries of origin and apply for U.S. citizenship.
Here's how Arizona Gov. Janet Napolitano characterized that proposal in a February 2007 speech at the National Press Club: "What a joke."
"That would be like asking everyone who lives in New York City and Los Angeles to get up and move," Napolitano said, noting that many of those workers risked their lives to come to the United States or were brought here as children, and have children who are themselves U.S. citizens. "That presumes we have the administrative and legal infrastructure to handle such a mass exodus. We don't."
"We must have the courage to talk openly and honestly with the American people about the need to address immigration. And we must have federal legislation that is reality-based," Napolitano said.
As President-elect Barack Obama's choice to lead the Homeland Security Department, Napolitano will have an opportunity to pursue reality-based proposals of her own. Some of them are likely to involve the Secure Border Initiative, the Bush administration's multi-year plan for reducing illegal immigration and bolstering protections at U.S. borders.
"I think the new administration is clearly going to look at the whole SBI program and see what is the best strategy going forward," said John Mayer, a vice president at consulting firm Booz Allen Hamilton in McLean, Va. "Gov. Napolitano is very familiar with border operations and the impact SBI has had on the states."
As a former federal prosecutor and border-state governor, Napolitano has an understanding of the security and economic implications of what she has called failed federal immigration and security policies. In mid-2006, with an estimated 4,000 immigrants then crossing Arizona's 376-mile border from Mexico every day, she declared a state of emergency and deployed the National Guard.
But Napolitano also has been critical of the physical barrier the Bush administration has been building along much of the southwest border. "As I often say, 'You show me a 50-foot wall, and I'll show you a 51-foot ladder,'" Napolitano told the Press Club audience.
Mayer believes any redirection of SBI needs to be risk-based. "There are a lot of ways you can do border security. You can build fences, hire more Border Patrol agents, use unmanned aerial vehicles and cameras. None of these by themselves is the right answer, yet if they're integrated into a program that you balance with risk analytics, I think you can come up with a pretty sound border protection program that will not only work but be efficient in terms of allocation of resources," he said.
Homeland Security needs to do a better job of developing strategies and plans that are integrated across agencies within the department, according to Mayer. For example, he said, border security strategy must involve support from DHS' Immigration and Customs Enforcement bureau, not just the Border Patrol and Customs and Border Protection.
"A new secretary has the opportunity to be able to start with what's been accomplished over the last five years and really push this concept of one department in terms of how they collectively look at the missions across the department," Mayer said

Carlos Ulloa-Murillo, 20, of Honduras , Criminal immigrant in Morristown. Ulloa-Murillo was arrested and charged last summer for having sex with a 12-year-old girl. He made bail in August, and as is customary, Morris County authorities notified the federal Immigration and Customs Enforcement Agency that Ulloa-Murillo was in the country illegally.

The next news Morris County authorities got was that Ulloa-Murillo had been deported to his native country of Honduras. He never stood trial for his alleged crime. He had been scheduled to appear in state, Superior Court, Morristown, in January. Illegal residents who commit other crimes should be deported after the conclusion of their sentence, providing they are convicted. Being in the country illegally should not be any way to avoid punishment. There are times when law enforcement agencies
mistakenly do not communicate with each other, but from what I know so far, the problem here seems to lie with the immigration Judge . Ulloa-Murillo's deportation was approved by an immigration judge. That would have been a judge who had his file and who was aware of the charges pending against Ulloa-Murillo.If the judge was not aware, he should have been. The line that immigration judges deal solely with immigration issues makes no sense. The suspect should not have been deported before answering for his alleged crimes.Morris County authorities say they'll try to find out what happened.

I hope their inquiries will result in something like this not happening again, and that Murillo will stand trial for his crime against America and for his alleged crimes against a child !!!

In Operation Predator sweeps across the country conducted between 2003-2007, Immigration and Customs Enforcement agents nabbed over 10,700 foreign national child molesters.
Many of these predators had been previously convicted of other crimes, and many had already been deported once. The number predators apprehended in the sweeps actually only represent the tip of the iceberg. In fact, a study conducted by the Violent Crimes Institute reports that between 1999 and 2006, there were nearly 1,000,000 sex crimes committed in the United States by illegal aliens. Using U.S. Department of Justice, Immigration, as well as state and local law enforcement data, Deborah Schurman-Kauflin of the Violent Crimes Institute determined that there are no less than 240,000 illegal alien sex offenders currently inside the U.S.

Who has all the money that is making the United States so broke right now ?

As the head of a family who has lost more money in the last five years to Criminal Immigrants then we have been able to save, I have a real easy time answering these questions.
Yet, I have an extremely sickening and awful taste left in my mouth when I finish answering.
As for my heart and my soul , they are left feeling as empty as my wallet.

$200 Billion dollars a year in suppressed American wages are caused by the illegal aliens. $11 - $22 Billion is spent on welfare to illegal aliens each year.
$12 Billion dollars a year is spent on primary and secondary school education for children here illegally. If we all look at the $90 Billion dollars a year that is spent on illegal aliens for Welfare & social services by the American taxpayers, and the $2.5 Billion dollars a year that is spent on Medicaid for illegal aliens, with the $2.2 Billion dollars a year that is spent on food assistance programs such as food stamps, WIC, and free school lunches for illegal aliens. We cannot leave out the cost to incarcerate illegal aliens at $3 Million Dollars a day. I can't verify that amount but if it's true, it's over a billion dollars each year. Let's not leave out the small fact, that 30% percent of all Federal Prison inmates are illegal aliens.

Let me leave some food for thought .
Of all that money wasted, out of all those Billions of dollars ,
The National Policy Institute, has estimated that the total cost of mass deportation would be between $206 and $230 billion.
That’s an average cost of between $41 and $46 billion annually over a five year period.
